From 4 December, businesses without shelters will be banned from operating, and managers face criminal liability. A shelter for 10 people costs UAH 1 million on average.

According to Oleksandr Derkach, co-owner of the Milk Alliance group, under Cabinet of Ministers of Ukraine Resolution No. 1092 Certain Issues Concerning the Optimisation of Civil Protection and Response to Threats from Air Attack Weapons’, as amended by Resolution No. 1128 of the Cabinet of Ministers of Ukraine dated 15 September 2026 businesses will be prohibited from operating from 4 December if they have no shelters or safe spaces. Otherwise, managers face criminal liability.

«I’m not surprised that the state is shifting all its problems onto business — after all, it’s so rich and prosperous here. I’m not surprised that the managers and owners of these businesses are being made hostages of the situation», Derkach writes.

He says business is caught between four fires: on one side, the state, which needs to be paid taxes; on another, staff, who need to be paid wages; on the third, russian drones; and on the fourth, a prosecutor with a criminal charge.

«None of that surprises me. It’s just the background against which we somehow have to survive. What does surprise me is how detached from reality the authors of this decision and those who voted for it are».

Derkach also gives specific figures: a shelter for 10 people currently costs UAH 1 million on average, and one for 20 people up to UAH 3 million.

«With what money, who will build them and where, and what will everyone else do with their businesses? A rhetorical question», he notes.

«If you can’t give business anything, at least don’t stop it from working», Oleksandr Derkach concludes.
